These Terms of Service ("Terms") govern your use of the micro-bloom mobile application and the microbloom.app website (together, the "Service"). By using the Service, you agree to these Terms in their entirety.

2. Description of the Service

micro-bloom is a wellness application designed for parents of young children. It offers personalized micro-activities (guided breathing, gentle movement, journaling, micro-learning) adapted to the user's available time and energy state.

micro-bloom is not a medical device and does not provide medical, psychological, or therapeutic advice.

The application is not a substitute for professional medical or psychological care. If you are experiencing mental health difficulties, we encourage you to consult a qualified healthcare professional.

3. Registration and Account

Certain features require creating an account. By creating an account, you agree to:

  • Provide accurate information during registration
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activity that occurs under your account.

4. Free Tier and Premium Subscription

4.1 Free tier

micro-bloom offers free access to a set of core features, including a selection of wellness activities. The scope of the free tier may evolve over time.

4.2 Premium subscription

The premium subscription provides access to additional features, including: expert masterclasses, smart calendar integration, offline mode, and exclusive content.

The premium subscription is billed through Apple In-App Purchase. Payment, renewal, and refund terms are governed by Apple's terms:

  • Payment is charged to your Apple ID account upon confirmation of purchase
  • The subscription renews automatically unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel your subscription from your iOS device Settings → Apple ID → Subscriptions
  • Refund requests must be addressed to Apple in accordance with their refund policy

4.3 Promotional offers

Promotional offers (free trial periods, complimentary months, etc.) may be made available. Specific terms for each offer are provided at the time of enrollment. At the end of the promotional period, the subscription renews at the standard rate unless cancelled.

5. Intellectual Property

All content in the application (texts, guided activities, illustrations, sounds, interface, source code, the "micro-bloom" brand) is protected by intellectual property law and remains the exclusive property of the publisher.

You are granted a personal, non-exclusive, non-transferable, and revocable license to use the Service for personal use only.

You may not:

  • Reproduce, distribute, or modify the application's content
  • Disassemble, decompile, or attempt to extract the source code
  • Use the Service for commercial purposes without authorization
  • Remove or alter intellectual property notices

6. User Content

Content you create within the app (journaling entries, personal notes) belongs to you. Journaling entries are stored locally on your device by default.

By using synchronization features (if enabled), you grant us a limited technical license to store and transmit this content solely to provide the synchronization service.

7. Acceptable Use

You agree to use the Service in accordance with these Terms and applicable laws. You may not:

  • Use the Service in any way that could damage, disable, or compromise its operation
  • Attempt unauthorized access to the Service's systems or data
  • Use automated means (bots, scrapers) to access the Service
  • Share your account with third parties or resell access to the Service

8. Service Availability

We strive to ensure the Service is available 24/7, but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue all or part of the Service with reasonable notice, except in cases of emergency.

9. Limitation of Liability

micro-bloom is a general wellness tool and not a medical device.

  • The Service is provided "as is" and "as available"
  • We do not guarantee that the Service will meet your specific expectations or produce particular wellness outcomes
  • We are not liable for indirect, incidental, or consequential damages related to the use of the Service
  • Our total liability is limited to the amount you have paid for the Service in the preceding 12 months

These limitations apply to the extent permitted by French law. Nothing in these Terms excludes or limits our liability for intentional misconduct or gross negligence.

10. Termination

You may stop using the Service at any time by deleting your account from within the app or by contacting us by email.

We reserve the right to suspend or delete your account in the event of a violation of these Terms, with prior notice except in cases of serious breach.

Upon termination, your right to access the Service ends immediately. Active subscriptions remain subject to Apple's refund terms.

11. Data Protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

Your data is hosted in Europe (EU) in compliance with the GDPR.

12. Changes to These Terms

We reserve the right to modify these Terms. In the event of a material change, you will be notified via the app or by email at least 15 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the competent French courts shall have exclusive jurisdiction.

In accordance with consumer protection regulations, you may use the European Online Dispute Resolution platform free of charge: https://ec.europa.eu/consumers/odr

14. General Provisions

  • If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect
  • Failure to exercise any right under these Terms does not constitute a waiver of that right
  • These Terms constitute the entire agreement between you and micro-bloom regarding the use of the Service
